Offenses in Spain: What are the risks for drivers?

During the summer holidays, many French drivers cross the Spanish border by car. However, the Spanish traffic laws differ slightly from those in France. In case of an offense, what are the risks for French drivers? Let’s take a look.

If I’m caught by a speed camera in Spain, do I have to pay a fine?

Yes. Since March 11, 2015, a European Union directive has facilitated the cross-border exchange of information on traffic offenses. With this measure, EU members have access to vehicle registration data and therefore the contact details of French drivers.

Which offenses committed in Spain result in a fine?

These information exchanges are governed by European Directive 2015/413 and apply only to certain traffic offenses:

  • Speeding
  • Failure to wear a seatbelt
  • Running red lights
  • Driving under the influence of alcohol
  • Driving under the influence of drugs
  • Failure to wear a helmet for motorcyclists
  • Driving on a forbidden lane
  • Unauthorized use of a phone or communication device while driving

In the case of one of these offenses, the driver with a French registration will receive a registered letter in French from the Spanish traffic authority. It will indicate the nature of the charges against them and the amount of the fine, which corresponds to the one prescribed by the country where the offense took place, such as Spain, and not the one specified by French traffic laws.

Can I lose points on my driver’s license for an offense in Spain?

No. The French point system does not apply abroad, even in a European Union member country. Therefore, there is no point deduction for an offense committed in Spain.

What are the speed limits in Spain?

In urban and built-up areas, the maximum authorized speed is 50 km/h. On non-urban roads, it is 90 km/h, and on roads with an emergency lane, it is 100 km/h. On motorways, the maximum speed is 120 km/h, compared to 130 km/h in France.

What is the cost of a fine for a traffic offense in Spain?

For areas limited to 50 km/h or less, here are the fine amounts:

  • Exceeding the limit by less than 20 km/h: €100 fine
  • Exceeding the limit between 21 and 30 km/h: €300 fine
  • Exceeding the limit between 31 and 40 km/h: €400 fine
  • Exceeding the limit between 41 and 50 km/h: €500 fine
  • Exceeding the limit by more than 51 km/h: €600 fine

For areas limited to more than 50 km/h, here is the scale:

  • Exceeding the limit by less than 30 km/h: €100 fine
  • Exceeding the limit between 31 and 50 km/h: €300 fine
  • Exceeding the limit between 51 and 60 km/h: €400 fine
  • Exceeding the limit between 61 and 70 km/h: €500 fine
  • Exceeding the limit by more than 71 km/h: €600 fine

Two criteria determine the fine amounts for speeding in Spain: the speed exceeded and the limit in force on the respective road.
The tolerance for mobile speed cameras in Spain is 7 km/h up to 90 km/h and 7% for speeds beyond 90 km/h. For fixed speed cameras, it is 5 km/h up to 100 km/h and 5% beyond that. When in doubt about the nature of the camera, it is better to apply the “norm 5” and avoid the fine.

How can I contest a fine in Spain?

Under European law, a driver has the right to contest a fine received outside of France. According to Article 336 of the Reglamento Nacional de Tránsito, a motorist has twenty days to contest a penal fine, such as those related to traffic offenses. During this period, the driver must gather all evidence (witness statements, photos, etc.) contradicting the charges.
If the appeal is rejected, it is possible to file a second appeal within five days of the initial decision. If no judicial decision is made, the case expires after one year, and the fine is waived.

Can my license be suspended in Spain if I commit multiple offenses? Yes. A serious offense or a repeat offense can lead to the retention or suspension of a French driver’s license in Spain. In such cases, it is advisable to seek assistance from a local lawyer to fully understand the procedure and its implications.
